Nayatel Files a Court Petition Against PTA over Alleged Discrimination in 2022

Nayatel, one of Pakistan’s leading internet service providers, has filed a court petition in Islamabad High Court (IHC) against the Pakistan Telecommunication Authority (PTA) for alleged discrimination in launching its service in Azad Kashmir (AJK). On Friday, Justice Aamer Farooq heard Nayatel’s plea.

According to Nayatel’s petition, the PTA’s alleged discriminatory treatment began when the company attempted to provide fibre broadband services in AJK.

The Special Communication Organisation (SCO), a government-owned entity under the administrative control of the Ministry of IT and Telecom (MOIT), operates commercial telecom businesses in AJK and GB.

The PTA was accused by Nayatel of the following attempts:

  • PTA delayed licence applications for more than 270 days, even though a new licence must be issued within 120 days.
  • PTA postponed the issuance of commencement certificates for no apparent reason.

The Authority is also delaying the hearing and decision of appeals that were required by law to be decided within 30 days in order not to jeopardise the company’s operations.
According to the petition, on January 20, 2022, PTA issued a notice to Nayatel as a warning of action after its CEO raised industry issues and PTA’s discriminatory treatment at a national broadband forum in Islamabad in November 10, 2021.

According to the petition, there is a conflict of interest between the PTA Chairman and the SCO. The former remained the SCO’s director-general for two years before retiring and being appointed PTA chairman by the previous government in January 2019.

PTA, on the other hand, has not commented on this because of the weekend. However, Justice Aamer Farooq served notices on the PTA, Cabinet Division, and Ministry.
